1 · Who's selling

Seller: Avocadog (sole proprietor — full name on request via hello@avocadog.store), a natural person operating under unregistered economic activity (unregistered economic activity) within the meaning of art. 5 sec. 1 of the Polish Entrepreneurs' Law. Seller has no Polish NIP/VAT registration. As a foreign seller to US consumers, seller has no US business presence and operates under bootstrap sales tax mode (no collection below state nexus thresholds).

2 · What we sell

Pet accessories — cooling mats, calming donut beds, slow feeder bowls, lick mats — to consumers in the United States. We do not sell to businesses for resale (B2B / wholesale).

3 · How an order works

You add items to cart and check out via Shopify.
You choose a payment method (the methods listed at checkout: cards, PayPal, Apple Pay, Google Pay, Shop Pay, Affirm, Afterpay).
The contract is concluded the moment you receive an order confirmation email.
We ship from our partner warehouse in California within 24h on business days.

4 · Pricing & currency

All prices are in US Dollars (USD). Prices shown on product pages are exclusive of any applicable sales tax. Because seller has no US sales tax nexus and operates in bootstrap mode, no sales tax is currently collected at checkout. If your state requires consumer use tax on out-of-state purchases, you may be responsible for self-reporting it on your state tax return.

5 · Shipping

Flat $4.90 in the lower 48 US states. Free over $79. Alaska, Hawaii, and US territories: flat $9.90. Delivery times: see our Shipping page.

6 · Returns & refunds

30-day no-questions-asked returns. Full details on our Returns page. Refunds processed within 10 business days of receiving the returned item, in line with FTC rules.

7 · Warranty & defective items

All products are sold "as is" except for the implied warranty of merchantability under the Uniform Commercial Code (UCC) where applicable. If a product is defective on arrival or fails within 30 days due to manufacturing defect, we replace it free of charge. To file a claim, email hello@avocadog.store with your order number, a description, and photos. We respond within 7 business days.

8 · FTC compliance

We follow Federal Trade Commission rules on e-commerce: no fake reviews, no dark patterns, no hidden fees, no subscription traps. Shipping and return terms are clearly stated upfront. Refunds are issued within 10 business days of receiving the returned item or original payment authorization, whichever applies under FTC rules.

9 · Limitation of liability

To the maximum extent permitted by applicable law, seller's total liability for any claim arising from your purchase is limited to the amount you paid for the affected product. Seller is not liable for indirect, incidental, consequential, or punitive damages, or for damages caused by misuse of the product (including supervised chewing, outdoor use beyond intended scope, or use by a pet outside the recommended size range).

11 · Intellectual property & DMCA

All site content (text, images, logos, "AVOCADOG" mark) is owned by seller or used under license. If you believe content on this site infringes your copyright, send a written DMCA notice to hello@avocadog.store including: (a) physical or electronic signature, (b) identification of the work claimed to be infringed, (c) identification of the allegedly infringing material and its URL, (d) your contact information, (e) a statement of good faith belief, (f) a statement under penalty of perjury that the information is accurate and that you are authorized to act. We respond within 14 days.

12 · Binding arbitration & class action waiver

Please read carefully — this section affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to your purchase or these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware (or remotely, at your option for claims under $25,000). Judgment on the award may be entered in any court of competent jurisdiction.

You and seller agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Right to opt out of arbitration: you may opt out of this arbitration agreement by emailing hello@avocadog.store with subject line "Arbitration Opt-Out" within 30 days of your first purchase. Opt-out preserves your right to pursue claims in court.

Claims under $250 may, at your option, be brought in small claims court in your state of residence instead of arbitration.

13 · Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules, and by applicable US federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14 · Changes

We may update these Terms. The version applicable to your order is the one published on the day you placed the order. Material changes for future purchases will be announced on this page with a new effective date.

15 · Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
